I have had over two years of hell with Charles Crumpley and his "other company" of Aztec renewable energy inc. I wish I knew what I now know about him and his companies then, before I wrote the check and was looking for a quality business to do the job I needed done. I believed the puffery he put on his website and social networks. Back then, positive reviews and lack of negative ones seemed to make him a good choice to go with. The addition of high rating from the BBB, Angie's list and home advisor, all added up to the feeling it was a good company. And his claims he has done so much to advance solar in Texas and worked with governments to advance solar seemed like just who I need. He as the ability to get things approved, he stated as much.
What I failed to look for is what I still fail to find now. Any google info of news reports that he has done the things he says he has. Maybe I just have not used the right keywords, but I still can't find support for his claims.
I took a long time speaking with his sales rep to define what I was looking for and got the proposal for. I next made the mistake of paying a large down payment of $18212.26. But they are the self labeled "experts", so lets do it!
They stated they do these jobs in four to six weeks. Four weeks in no communication, I ask show me a building permit, show me progress. Six weeks in I email again building permit or a refund. Promises excuses and refiling things for months, no communication for months, frustration, upset, trying to find anyway to resolve things, even a new contract for a smaller system in a new location resulted in the same nothingness. Till I was told all my money was used up on expenses. And here we are...
This is what I now know... Charles crumpley stated in his Angie's list listing "...TECL#29509....Aztec Renewable Energy, Inc.. Also known as Aztec Wind Energy and Solar Power. Business was previously known by We Know Technologies...." ( https://member.angieslist.com/member/store/10757042/about ).
So in his own words Aztec Renewable Energy, Inc is now in business doing similar activities as Weknow Technologies inc. Which may not have even been something that was questionable to me until I found that, In March 2013 WeKnow filed for voluntary chapter 7 bankruptcy at "...Texas Northern Bankruptcy Court. Case number 3:13-bk-31604. Judge Harlin DeWayne Hale. Chapter 7. Filed Mar 29, 2013. Type voluntary..." ( https://businessbankruptcies.com/cases/weknow-technologies-inc )
This is what I found online in July of 2018 in the findings of their appeal of the judgment where a jury found WeKnow misapplied trust funds and were to pay actual damages, and attorney fees. I also found this information... "...WeKnow’s bankruptcy schedules stated that, within one year prior to the filing of the bankruptcy petition, WeKnow had distributed over $40,000 to Charles Crumpley (Charles), WeKnow’s president and chief executive officer. Further, in the ninety days immediately preceding the filing of the bankruptcy petition, WeKnow had transferred over $75,000 to Aztec Renewable Energy. Charles described Aztec as his “other company” that WeKnow hired to complete several jobs. According to the bankruptcy schedules, WeKnow had only $300.34 in its checking and savings accounts as of April 19, 2013. On November 25, 2013, WeKnow filed a Certification of Termination of a Domestic Entity with the Texas Secretary of State, stating it had made a voluntary decision to “wind up” its business operations. On December 9, 2014, Hayes sued WeKnow for breach of contract and WeKnow and Charles for violations of the Act.
The jury found WeKnow breached its contract with Hayes, but the breach was excused due to impossibility of performance. The jury also found WeKnow violated the Act, but Charles did not. The jury found WeKnow had misapplied trust funds in the amount of “$5,000 + tax,” and awarded Hayes actual damages of $5,508.87..." ( https://www.courtlistener.com/opinion/4515818/weknow-technologies-inc-v-joe-hayes/?q=Charles+crumpley )
It's just not how I'd personally like bankruptcy used - to escape paying creditors, by transferring funds out from one company that is voluntarily going bankrupt, then into another similar one, thereby funding it to continue doing similar business under another name after you voluntarily end the bankrupt business.
He even seems to me to try to capture the name recognition from WeKnow and apply it to Aztec by what he stated earlier in his Angie's list listing.
But, regardless of what I personally think about it, the fact is that it was upheld - WeKnow Technologies Inc,, as was found by a jury to have misapplied trust funds, and still had to pay the actual damages of $5,508.87.
Today Charles makes threats to me about slander and defamation. Stating even I'm liable for having to pay his legal fees to defend against it by placing a lien against me to collect damages. "...We have attorney's that can clean up what ever you think you can do, collect damages and file liens. The confidentiality agreement was to prevent any additional cost in the future. We are just spinning it now and billing you for it..."( https://dallas.app.bbb.org/complaint/view/91453953/c/w3j47r )
I don't think that is legal nor the reason contractors have the ability to place liens, but it shows me trends. Like he threatens legal action for things he does not like but are not illegal, He tries to make contractual responsibilities or more exactly attempts to justify claims of expenses that never were in a contract at all but that he just claims it is what eroded all my money from the project. Never once have I received any summary of expenses to document what he claims it is that eroded my money.
I have not canceled a project with crumpley. I did agree to his second contract to change the project to one in Seguin. In effect, he canceled in writing the first contract with his second contract - he wrote. At that point he stated Seguin was paid in full by my total prepaid amount. There were no expenses to date then deducted by him for services from the first contract.
This next statement shows now messed up his logic is, to blame me for doing things that as a businessman really were his decisions he should have made. And in the same paragraph he contradicts things from one sentence to the next. Remember six weeks in I asked for a refund because of inaction and he could have canceled it then. I also have an email proving he did not buy the equipment on our original contract so later he had to refile for rebate approval again because that equipment was no longer available so storage for equipment for my project???
And for the second contract I never got a design, nor a plan, nor any permits, nor schedule, nor anything showing progress on that project at all, let alone any proof of any expenses at anytime.
"I'm sorry that your project turned into such a mess. You should have canceled rather than requiring my staff to keep managing and storing your equipment. You certainly should not have canceled my attempt to get your bleeding project ( taxes paid) off our books. "( https://dallas.app.bbb.org/complaint/view/91453953/c/w3j47r )
I don't understand asking for a refund is not canceling but asking if we can do the smaller project in the original location is and somehow that breeches the contract and you can keep all my money!!
Yet that provision is not written in the contract at all? But what is written is prepaid in full $18212.26 and you did nothing so I want a refund now!! That was and is my position on this. I will not settle for his too little for too much bs settlement offer at all now and not be able to tell this story to the world.
So all the things he now wants to use as previously claimed eroded my money on this project, are not an issue at all. What does he try to do next, make an expense up at a rate that would erode my money and make a claim if I don't do as he wants, I "Abandoned" his offer - the only offer and the one he wants to force me to accept. "Please come get your equipment out of our warehouse in Denton, Texas. We no longer require that location and the rent is $1.600 per month. You have 10 days or it will be considered abandoned! "( https://dallas.app.bbb.org/complaint/view/91453953/c/w3j47r )
Unlike Crumpley I do not have to "create the credible response", I tell the truth supported by emails, many proving what I say with Crumpley's own words - "I have not had time to get this to our attorney as I had to create the credible response first. The response and supporting documents will go to him next. This expense will further erode the project. You may end up with nothing but our attorney filing a law suit after you have been officially served and notified. "( https://dallas.app.bbb.org/complaint/view/91453953/c/w3j47r )
More telling are his statement of his ability to remove negative statements online, this may explain why when I looked back then more were not there to find. "...But please remove your online post. It's not going to work the way you want. I have had many online disputes removed..." ( https://dallas.app.bbb.org/complaint/view/91453953/c/w3j47r ) Again he tries it, "All the review stuff can be removed. The only one that has no point of return is the BBB. If this stays, I have nothing to offer you..."( https://dallas.app.bbb.org/complaint/view/91453953/c/w3j47r )
I looked back into everything at this point and found again by his own words things that make him look so bad. I did as he suggested on his website. Checked on his license with the Texas department of license and regulation. I clicked the link he provided. Which, brought up the issue of a problem with his license, but I'm no expert on this either. Here is what it says, you decide
"...Electrical Contractor License #: 29509 Expiration Date: 03/28/2019 Type: EC Phone: (866) 933-6344
No Master found
According to our records, this Electrical Contractor does not have a current Master Electrician license assigned. An Electrical Contractor cannot perform electrical work or electrical contracting if its Master Electrician's license is expired, revoked, or is not on record with the Department."( https://www.license.state.tx.us/LicenseSearch/SearchResultDetail.asp?1=EECELE00029509 )
So he seems to be the very company we warns people about on his website. This is the page I read and found the link I clicked on to get to the tdlr search -
My point of view on him and his companies I found supported by other people who have made similar negative comments where crumpley has no control to make claims to remove them or to personally remove them himself. (See https://aztec-renewable-energy.pissedconsumer.com/review.html)
Moral of this nightmare!! Whomever you decide to go with check them out fully before hand. Granted some of this I could not have found because it did not exist, but had I looked deeper the there were things I could have found. Maybe I just wanted to believe because I waned to do this so much. I still believe in this design.
There is more to this story, and I will put it on blogs in its full version for everyone to see. This is not how I saw this going, but It is part of the story I really wanted to tell about the alternative ways to install solar when your roof is not optimal.
I believe it is these unique situations which prove which company is a quality company and which can at best just do the easy projects. Seems to me some people do not have the ability to accomplish the complex ones in a manner that is required to avoid voluntarily going bankrupt and restarting again under a new name. But I'm no expert, you decide for yourself.
There is so much more to this story which will be posted in a longer format but this is long enough, so I'll stop now.Read Less
