Workmanship Warranty

1. Equipment warranty. Equipment installed by Sunpath (solar modules, inverters, batteries, etc.) will be covered by the
manufacturers’ warranties (where applicable) protecting against component-related failure. Materials covered by the manufacturer
workmanship warranty include aluminum frames, glass, solar power, and junction boxes. In addition, manufacturers warranty the
performance of their solar modules for at least 25 years.

2. Workmanship warranty. Sunpath warrants that the System will be constructed and installed in a good workmanlike manner
according to the standards of care and diligence generally practiced by solar engineering, construction, and installation companies
when installing photovoltaic solar power systems of a similar size and type as the System in the geographic region where the Premises
is located, and pursuant to (i) good engineering design practices, (ii) manufacturer’s instructions, (iii) applicable law (including local
codes and standards), (iv) required governmental approvals and permits, and (v) applicable requirements of the local utility. This
Limited Workmanship and Installation Warranty will extend for a period of five (5) years from the date installation of the System is
completed by Sunpath Solar. This warranty covers the installation of the array itself, the electrical wiring connecting the array to the
customer wiring, and the interconnection to the utility, internal and external mechanical connections, and all electrical connections
from the array to the customer meter or electrical distribution service. The roof penetrations warranty will be for ten (10) years, but
limited to the warranty of the shingles or other roofing material. Sunpath shall not be responsible for special, incidental, or
consequential damages related to or arising under the Agreement. Sunpath shall not be responsible for damage to or modifications of
its work caused by other parties.
3. Production Guarantee. Sunpath guarantees that the System will generate at least 80% of the “Guaranteed Annual Production

(kWh)” for the first five (5) years under normal operating conditions. A table of Guaranteed Annual Production (kWH) will be
produced at the time Owner provides final sign-off on permit-set designs, and will be included as an addendum to this agreement.
First-year Guaranteed Annual Production (kWh) will be based on National Renewable Laboratory PVWatts production estimates
derated by system efficiency and known environmental conditions like shading. Subsequent year Guaranteed Annual Production
(kWh) will be the first year guaranteed annual production derated by the guaranteed degradation rate of the solar module. Actual
cumulative annual production will be calculated on a twelve (12) month basis starting from the day the system is commissioned and
fully operational. Cumulative annual production during normal operation conditions under 80% of the guaranteed annual production
(kWh) will be credited at the solar-avoided cost of the electric utility servicing the premises. Any system downtime caused by failure
of equipment covered by the equipment manufacturers warranty, damage to equipment caused not by fault of Sunpath or its
representative, or damage to equipment caused by acts of Force Majeure, will be deemed to not meet the standards of ‘normal
operating conditions'. Production lost from these conditions will not be counted against the cumulative annual production. Additional
obstruction of sunlight on the installed system, including planting of a tree, new growth on an existing tree, or the building of a
neighboring property etc voids the guarantee. Any tampering with the equipment or alteration by anyone other than Sunpath’s
representatives shall void the guarantee specified here. Production Guarantee can be extended if the Owner enters into an Annual
Maintenance Agreement with Sunpath.
